Movies in Marana - Vendor Terms and Conditions:
Set Up Time: All vendors must be set up and ready to go by 5:30 p.m. on the day of the event. Arrive by 5PM.
Fire Marshal (FOOD VENDOR ONLY)All vendor set-ups are subject to inspection by the Fire Marshal and/or Town staff must be in compliance with all Town, Health and Fire Codes. Fire extinguishers must be present and in good working order. A 2A-10BC fire extinguisher is required properly serviced and tagged. Depending upon the size of the catering vehicle, more than one fire extinguisher may be required. The Fire Marshal may shut down vendors who do not comply with the Fire Code adopted by the Town of Marana. Propane tanks must be secured and are required to be 20 feet away from tents and combustibles. Vendors may be required by the Fire Marshall to fence/secure the propane tank area from the public. Town of Marana will not provide temporary fencing.Health Department Permit: Vendors planning to sell food must obtain a temporary food service permit from the Pima County Health Dept., 5950 S. Country Club Rd., Suite 100, Tucson AZ 85714 or call (520) 243-7770. The Town of Marana will not refund any fees or deposits to any vendor closed for lack of permit or for failing inspection.
Tents: Vendors who are providing their own tent/canopy must weight the tent/canopy down and secure it. Sandbags and/or water barrels may be used. Staking is NOT permitted.
Electricity: Electricity is not provided.
Weather: The event will be outside. Vendors should be prepared for inclement weather. Vendors will be notified in advance of cancellations due to weather.
Water: Water is not provided. Vendors must supply their own water.
Vehicles: Vendors will not be able to drive up to their designated space. Vendors should be prepared to drop off materials/supplies/equipment and cart them a very short distance to their designated spot. Request's to drive up to a vendor space must approved by Recreation Supervisor, Shelby Scheer in advance.
Items Sold: The sale of weapons of any kind, including, firearms, knives, or whips is prohibited at this event. Also, items such as fart gas, stink bombs, poppers and silly string shall not be sold. Vendors selling or attempting to sell any of these items will be closed and all fees will be forfeited.
Cancellation: If vendor cancels by Friday, September 15, 2023 vendor fees will be fully refunded except for a 10% administrative fee. If vendor cancels after Friday, September 15, 2023 vendor will forfeit all fees.
Marana Business License: All vendors are required to have a current Marana Business License or a Peddler, Solicitor or Transient Merchant License. License applications are available on the Town of Marana website at www.maranaaz.gov.For a list of exceptions, refer to Marana Town Code Chapters 9-1 and 9-2 or contact Lauri Young at (520) 382-1900.
Release and Indemnification Agreement: In consideration of the Town of Marana's acceptance of my Vendor Application for the Movie in the Park, I do hereby, for myself, my child/ren, my heirs, executors and assigns, release the Town of Marana and its agents, officials and employees from liability for any harm, injury, or damage, which I, or my minor child/ren, may suffer while participating in the above-described event. This includes all risks that are connected with the event whether foreseen or unforeseen. Additionally, I agree to defend, save, hold harmless, and indemnify the Town, its officials, employees, agents, successors, and assigns from and against any and all manner of claims, suits, lawsuits, action or actions, causes or causes of action, liabilities, damages, and other claims and demands of whatsoever nature or kind, in law or in equity, in tort or in contract, or otherwise caused by or resulting from my errors, omissions, or negligent or intentional acts in connection with the above-described event. I am of lawful age and legally competent to execute this Agreement. I understand the terms of this Agreement and have agreed to its terms as my own free act.
If I am acting on behalf of an organization, I certify that I am the agent of the organization, I am acting on the organization's behalf, and I am duly authorized to execute this Release and Indemnification Agreement on the organization's behalf.
By signing, I acknowledge that I have read and agree to abide by all the terms, conditions, rules and regulations outlined in the Movie in the Park Vendor Terms and Conditions and that I have read and understand the terms of this Release and Indemnification Agreement and agree that I shall be bound by its terms and conditions.
